SAUDI ARABIA: To ensure investor protection for defaults, the Capital Market Authority (CMA) is proposing new rules that would give priority to netting agreements – ahead of claims by the Bankruptcy Trustee or the Bankruptcy Commission. Provided that one of the parties involved is a capital market institution, the netting deal will not be otherwise viewed as providing “preference of an outstanding debt”.
